. max? >> reporter: yeah, so a good sign that prince william left the hospital. it meant that he wasn't overly concerned about his wife's condition. but having said that, she's still not 12 weeks pregnant. you normally wouldn't announce a pregnancy until 12 weeks. they were forced into an early announcement because kate was coming to the hospital here and it would have leaked. the queen and even prince charles weren't even told until today, so they haven't had time to be terribly concerned, but it's one of the best hospitals in britain and we'll wait and see. she's getting various treatments. being given nutrients and being told to rest. it's about making sure she can look after her body. eat enough food, making her strong enough to get through this early stage of the pregnancy. she'll be worried the information is out already, because it is very early on in the process. >> so then what do you think the implications are economically speaking? one has to imagine a little baby royal is going to bring even more interest all on the royal family. >> well, i'm always amazed about the story

are expecting. today william was back at the hospital who is being treated for an acute case of morning sickness. there he was going in earlier today. let's talk about kate first. i mean, this type of morning sickness that she has been suffering from affects 1 in 50 women and occurs more often when the woman is expecting twins. how is kate doing today? >> reporter: that's right. we're told that she will be in there for a few days and after that may need bedrest because what they describe is very acute morning sickness. it's pretty serious and she needs specialized treatment. you mentioned twins. just to look at the front page of one of our england's most conservative papers, could it be twins for kate? now, we don't know this. this is, frankly, speculation and the fact that you get a headline like this shows you how excited the country has become but it is the case, they say, that in cases like this, acute morning sickness, twins are more likely. and there is no history of twins in the middleton family or in the royal family. so we don't think it would necessarily be genetic if it were the case

high-profile cases that would help define the rights and benefits of same-sex couples. pete williams is the justice correspondent. he joins me from outside the supreme court. good morning, pete. >> reporter: good morning, chris. we're wait to go hear whether the court will take either of these two cases. the defense of marriage act passed in 1996 by congress, signed into law by president clinton. and what it says is that for federal law purposes, marriage can exist only between a man and a woman. so that means this in the nine states where same sex marriage is legal, if a same sex couple gets married there, they're considered mayrried for state lw but not federal law and the practical consequence is they are denied about 1,000 federal benefits, tax benefits, survivors benefits, to be covered under health insurance. that sort of thing. it will have to decide whether that law is unconstitutional discrimination, denying those couples equal treatment. what the advocates of overturning it say is never before has the federal government done anything but defer to a state's definition of wha
. joining me now is chris geidner. the man who knows the supreme court inside and out, pete williams. pete, good to have you with us. break it down. which cases are we talking about, and how quickly might we find out whether they will move forward? >> reporter: well, if they're going to take any of these cases, thomas, it's very likely we'll find out this afternoon. and i think the most likely event here is that they will grant one of the cases that challenges the federal defense of marriage act. passed in 1966 by congress signed by president clinton, it defines marriage as for federal law purposes as only the legal union of one man and one woman. now, the practical effect of that is that in the nine states that now grant or soon will grant same-sex couples the legal right to get married, those couples are legally married under state law, but the federal government doesn't recognize their marriage, which means that they can't get survivors' benefits, they don't get tax benefits, they don't get social security benefits. about 1,000 benefits in all that are the result of this federal law tha

correspondent pete williams. so, pete, what happened was basically the white house didn't view the senate as in recess though republicans were doing the same gig. >> reporter: the question here legally, is the senate in recess. the obama administration says, no. the sessions are a sham. they last less than a minute. the congress or the senate when it decided to do this passed an order saying that no business would be conducted during these pro forma sessions. what are more do you need? the senate says we'll decide whether we're in recess or not and we say we're not, and not only that in the early part of the recess from december of last year to january of this year, the senate actually passed an extension to the payroll tax cut. so is the senate in recess or not? and this is it either going to go to the supreme court, chuck, or the courts are going to say, you know what, we can't -- this is a dispute between the political branches. you guys work it out. i don't think it's 100% clear whether the courts will decide they can decide this question. >> that seems odd. i want to throw up a graph

that could ultimately define marriage under federal law. william la jeunesse following this story out of los angeles now. william, what's happening today? good morning. >> reporter: well is the federal law that defines marriage as a union of a man and woman constitutional? the nine justices today will decide if they want to take that case up this spring. now there are 10 pending cases involving gay rights before the court. eight involve challenges to the defense of marriage act known as doma. it bars the federal government from recognizing same-sex marriages, and, it says one state does not have to recognize the same-sex marriage of another state. it was signed into law in 1996 but then president clinton, it was passed by large majorities in both houses including large margins of democrats. president obama was before the law before he was against it. but now the administration is pushing the supreme court bill to overturn doma as well. already two lower courts said the clause that bars same sex spouses from receiving federal benefits like social security, survivor benefits, insurance, violat
